Terms of Service

These Terms of Service ("Terms") govern your use of the SyncCouch website at synccouch.com, the SyncCouch Chrome extension, and the SyncCouch mobile application (collectively, the "Service"), operated by SyncCouch ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use SyncCouch. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that you have your parent or guardian's consent.

2. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your account with others or allow unauthorized access. Notify us immediately at hello@synccouch.com if you suspect unauthorized use of your account.

3. Acceptable Use

When using SyncCouch, you agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Harass, abuse, threaten, or intimidate other users through chat, voice, or video communication
  • Share sexually explicit, violent, or hateful content in chat messages or through the Service
  • Attempt to circumvent, disable, or interfere with any DRM or content protection technology on streaming platforms
  • Record, capture, redistribute, or download any video or audio content from streaming platforms using SyncCouch
  • Use automated scripts, bots, or crawlers to access or interact with the Service
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Impersonate another person or misrepresent your identity
  • Spam, flood, or disrupt watch rooms or chat functionality

4. Streaming Platform Subscriptions

SyncCouch does not provide access to any streaming content. Each user must have their own active subscription to the streaming platform they wish to watch on (e.g., Netflix, Prime Video, JioHotstar). SyncCouch only synchronizes the playback state between users by interacting with the public HTML5 video player API. We do not circumvent DRM, access video streams, or provide any content.

5. User-Generated Content

You retain ownership of content you create (chat messages, profile information). By using the Service, you grant us a limited license to transmit, display, and process this content as necessary to operate the Service. Chat messages are ephemeral and are not stored after your watch room session ends.

We reserve the right to remove or filter content that violates these Terms or our content moderation policies, without prior notice.

6. Content Moderation and Reporting

SyncCouch uses automated content moderation (keyword filtering and AI-based toxicity detection) to maintain a safe environment. Moderation is not perfect — if you encounter inappropriate content or behavior, use the in-app report feature or email us at safety@synccouch.com.

You can block any user at any time. Blocked users cannot join rooms you create.

7. Free Tier and Limitations

SyncCouch is currently free to use. Certain features have usage limits:

  • Video chat: 30 minutes per week per user
  • AI recommendations: 3 requests per day per user
  • Room creation: maximum 10 rooms per hour per user

We reserve the right to modify these limits, introduce paid tiers, or change pricing at any time with reasonable notice.

8. Account Termination

By you: You may delete your account at any time by contacting us at hello@synccouch.com. Upon deletion, we will remove your personal data within 30 days, except where retention is required by law.

By us: We may suspend or terminate your account if you violate these Terms, including but not limited to: repeated abusive behavior, attempts to circumvent DRM, or use of automated tools against the Service. We will make reasonable efforts to notify you before termination, except in cases of severe or illegal violations.

9. Intellectual Property

The SyncCouch name, logo, and all associated branding are our property. The Service's code, design, and documentation are protected by copyright. You may not copy, modify, or distribute any part of the Service without our written permission.

Streaming platform names and logos (Netflix, Prime Video, YouTube, JioHotstar, Crunchyroll) are trademarks of their respective owners. Their use on SyncCouch is for informational purposes to indicate platform compatibility and does not imply endorsement.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or compatible with all streaming platforms at all times. Streaming platforms may change their player implementations, which may temporarily affect SyncCouch functionality.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SyncCouch and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to: loss of data, loss of profits, or damages resulting from unauthorized access to your account.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or INR 1,000 if you have not made any payments).

12. Indemnification

You agree to indemnify and hold harmless SyncCouch and its developers from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or by posting a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
